2016 has been referred to as “The Year of Online Extortion.” On average there have been 4,000 daily ransomware attacks – an increase of 300% over 2015.
Healthcare entities are the new favorite target for online criminals due the lack of focus on cybersecurity by the healthcare industry as a whole and the dependence healthcare providers have on up-to-date information contained within their patient records.
In addition to costly downtime, ransomware now poses an even greater threat to healthcare providers and business entities due to new guidelines just released by the Health and Human Services Department’s Office for Civil Rights. Per their guidelines released July 2016:
“When electronic protected health information is encrypted as the result of a ransomware attack, a breach has occurred because the ePHI encrypted by the ransomware was acquired (i.e. unauthorized individuals have taken possession or control of the information), and thus ‘disclosure’ not permitted under the HIPAA Privacy Rule.”
Based on these factors, the entity must then comply with the applicable breach notification provisions including notification to affected individuals, to the Secretary of HHS and to the media for all breaches affecting over 500 individuals. The cost associated for notification and credit monitoring required following a breach poses significant threat to the financial stability of the organization.
